Question #1 Shepardizing a case is the process of identifying reports made on previous cases on the Shepard citations. This citation contain the volume and page number of the decisions made by the court on the previous cases. Question #2 Plessy v Ferguson is a case of an African-American man, a train passenger Homer Plessy. He was arrested because he refused to sit in the all-black section car. The case was overruled on May 17th, 1954. Plessy filed a suit claiming that his civil rights were violated. The case that overruled Plessy was Brown v Board of Education of Topeka. lt was a case file by Oliver Brown in 1951 and appeared in the Supreme Court in 1952. He filed this case after his daughter was denied entrance to all-white schools in Topeka.
Question #3 ln 1892 the Supreme Court upheld the law of separate but equal. They rejected Plessy argument and ruled that a law that implies to merely a legal distinction between black and white was not unconstitutional. ln 1954 it was overruled on the basis Brown’s case. That the law of separate but equal does not apply to public education and segregate schools are unequal. Thus they are deprived of their equal protection by the law as stipulated in the 14th amendment.
